GENERAL TERMS AND CONDITIONS

Mulec Weddings is the name under which a team of photographers works under the leadership of Mulec Anže (Fotografija in oblikovanje, Anže Mulec s.p.), hereinafter referred to as Mulec Weddings or the Photographer.

All published content on the website www.mulec-weddings.com, including photographs, is the property of the Photographer and is copyrighted, unless otherwise stated. Appropriation of these works without the written permission of the authors is prohibited.

The Client is a natural or legal person who orders a service from the Photographer's offer.


BEFORE THE WEDDING

- APPOINTMENT RESERVATION AND PAYMENT

By ordering and paying for the reservation of the photography service, the Client undertakes to be familiar with the execution, price, deadline, date and method of payment, which confirms that he agrees with the general terms and conditions written below. The prices of the services are published in the price list or the offer that the Client receives upon request and is forwarded via e-mail or other written communication.

The Client confirms booking of the date and order of photographic services by paying non-refundable retainer of 300 EUR. Any verbal agreements or bookings without payment of the booking retainer are not considered as final booking of the date and the Photographer can continue to market the date as available. Only with the payment of the reservation retainer and a confirmed transaction, the date is considered as booked, and the Photographer no longer offers this date to other potential Clients or wedding couples. Mulec Weddings can accept only one booking per one available date.

The amount already paid for the booking of the date will be deducted from the total final amount of the selected package. The rest of the photo shoot costs (total 100% of the amount) can be settled before or after the wedding to a bank account provided by Mulec Weddings. If payment is not made, Mulec Weddings is not obliged to prepare and hand over the photos, the amount paid for the reservation will be withheld.

- WEDDING CANCELLATIONS AND POSTPONEMENTS

To cancel the booking, the Client must notify the Photographer in writing. In case of cancellation of an already booked date by the Client, the Photographer retains the amount for booking the date. Exceptions are cancellations due to unforeseeable events that cannot be influenced (death, death in the immediate family, traffic or other serious health-related accident, complications in pregnancy, quarantine order, etc.), in which case the Client will be offered a transferable credit upon presentation of proof, which can be used for other service from our offer (photography or photo booth).

In the case of rescheduling the already booked date, Mulec Weddings undertakes to do its best to find and offer a new available date for photography.

• In the event that the Client postpones to a new date on which Mulec Weddings is still available, the amount already paid will be transferred as a reservation for a new photography booking.

• In the event that the Client postpones to a new date on which Mulec Weddings is not available anymore and cannot offer the date, the amount paid will be withheld.

• If the Client announces the postponement of the wedding less than 120 days before the wedding date, this is considered as a cancellation of the booking, and the amount already paid for the reservation is retained by the Photographer. For booking of a new postponed date, payment of a new booking retainer fee is required.

When rescheduling the wedding date, the current package price lists valid at the time of the postponement are taken into account.

- CANCELLATION BY THE PHOTOGRAPHER

In the event that any photographer from the Mulec Weddings team is unable to fulfill the agreed obligations on the Client's wedding day due to unforeseen events beyond their control (injury, illness, force majeure, theft of equipment, etc.), Mulec Weddings will do its best to provide a replacement for the absent photographer with a photographer of comparable experience and skills. In the event that both photographers of the Mulec Weddings team are affected and the execution of the agreed services is not possible due to force majeure, the Client will be helped as much as possible to find an alternative provider. Only in the event that the Mulec Weddings team is unable to fulfill the agreed obligations, the booking retainer received will be returned to the Client and Mulec Weddings will no longer have any obligations towards Client.

- INFORMING THE PHOTOGRAPHER

Details on the organization of the event are agreed in advance in writing (via e-mail). Clients must notify the Photographer in writing of any changes. The Photographer cannot be held responsible for any delays or disruptions in the provision of the services until such changes have been received and confirmed in writing. The Client must provide the Photographer with accurate information about the scope, time of photography, location of photography and his wishes. It is recommended that, in case of specific wishes, the Photographer should be provided with a list of necessary photos, which the Photographer will take into account on the wedding day (if feasible). Complaints about uncaptured moments that have not been forwarded to the Photographer via the list in advance will not be taken into account after the wedding day.

No later than in a week before the wedding, the Client must send the Photographer a timeline of the wedding day, which includes information with the exact times and locations (addresses) of the event, as well as an emergency phone contact.

It is also crucial for the Photographer to know when and where the Photographer should start working, if this information is not provided by the Client (or the responsible wedding planner), the Photographer is not responsible for any complications or missed moments.


- PUBLICATION PERMISSIONS
Clients agree that the price in the offer takes into account that the Photographer will be able to use any photo for promotional purposes (advertising, brochures, articles in magazines, on websites, social media, sample albums, competitions, etc.) without the written permission of the Client. If Client does not allow Photographer to publish photos for promotional purposes, he must communicate this in writing before the event. As this means the loss of marketing opportunities for the Photographer, the Client will be charged additional non-display fee, which amounts to 400 EUR regardless of which wedding package is selected by Client.


AT THE WEDDING

- OBLIGATIONS OF THE PHOTOGRAPHER
The Photographer will take care of taking pictures of the elements included in the offer and in the written communication. The Photographer's responsibilities include photographing and accompanying the Client on their wedding day.
Mulec Weddings undertakes to perform the service in accordance with the General Terms and Conditions. He will perform the agreed service and deliver the final product within the agreed period. The Photographer is responsible for his own safety.


- PHOTOGRAPHING TIME/EXTRAS
The Client agrees that cooperation and punctuality are essential to achieve the goals and wishes of all parties. Photography starts at the scheduled start time and ends at the scheduled end time. Any additional time after the scheduled end time will be billed to Client based on the agreed quote. Additional hours of attendance are billed after a half-hour interval (billed for every half-hour of attendance that begins).

If, for any reason (weather conditions, illness, etc.), the Clients decide to interrupt the photography session, the amount of agreed shots may change as a result. In this case, the Photographer will subsequently inform the Client about the exact amount of shots to be delivered.


- FOOD
The Client should arrange meals for the photographers if the photo shoot is longer than 6 hours. It is also necessary to provide a place for photographers to eat. Photographers do not have to be placed among the guests, but it is highly recommended that they be close to the guests and the couple so that they can always observe event and have situational awareness, even while eating. If forced to eat away and far from the couple, photographers will not be responsible for missed photos of any unannounced speeches, surprises or events. In the event that the meals for the photographers will not be taken care of, the Client is obliged to communicate this, and the photographers will have 90 minutes during the reception of the wedding party to get the meals by themself.


- OVERNIGHT ACCOMMODATION
For all weddings that take place outside of 200 km from the Photographer's location (Podutik, Ljubljana), the couple will be obliged to pay for a hotel stay on the same day, for events that end after 10:00 p.m., and also for those that start before 10:00 a.m. , for the evening before. If the Photographer needs to spend the night on site due to any other reason such as logistical requirements, timetables and transportation restrictions, etc., the couple will either arrange for that stay or pay for it immediately. If the couple will book the necessary hotel nights at the wedding venue or another location nearby, the room will always be individual with its own bathroom, which the Photographer will not share with any other person (except another photographer on their team). Breakfast must also be included in the stay. The above does not apply to locations in Slovenia.

- RESPONSIBILITY
The Photographer is not responsible for missing photos due to causes beyond the Photographers control, including but not limited to intrusive guests, Client or guest lateness, weather conditions, schedule complications, incorrect addresses provided to the photographers, or restrictions of the locations. Mulec Weddings is not responsible if the photographers missed a certain moment due to the interference of the wedding party (disruption during work or setting up in front of the lens). The Photographer is not responsible for backgrounds or lighting conditions that may adversely affect or limit the coverage of the photograph. The Photographer is not responsible for missed coverage of any part of the event(s) not notified in writing prior to the wedding. The Photographer is not responsible for missing persons in group shots.

Although all equipment is regularly checked and reasonable measures are taken to provide spare equipment, the Photographer will not be responsible for photographs not produced due to unforeseen events (breakdown, failure, theft or destruction of photographic equipment, computers, discs) occurring during taking of photographs, during editing of photographs or during the distribution of photographs. If, due to the reasons listed above, the Client cannot receive all or part of the photos, Mulec Weddings is not responsible for the loss of the original photos taken, but undertakes to reimburse the Client for the amount paid for the photography service.

Any instructions given to the Client(s), their guests or employees during the photography session are deemed to be at the sole responsibility of those persons. The Photographer cannot be held responsible for any personal accidents during the photo shoot or/and for any accidents that occur on location (including damaged items, furniture, etc.). Guests may not move, touch or handle the Photographer's props and equipement unless otherwise instructed by the photographers. The Client will be responsible for any damage caused by guests to the Photographer's equipment and supplies.


- PERMISSIONS FOR PHOTOGRAPHY
Some locations and private venues/companies charge a photography permit fee. The Client is responsible for paying this fee. In the event that the Client fails to pay or refuses to pay any such permit fee, even though they have been advised by the Photographer that such a fee is required, the Client shall be responsible for any related costs or penalties.


AFTER THE WEDDING

- PHOTOGRAPHS AND THEIR PREPARATION
Mulec Weddings will, to the best of its ability, fulfill the Client's expectations and take into account his photographing wishes. Since each photo is the product of our own knowledge and current creativity, Mulec Weddings does not allow complaints about the composition and technique of the photos. The selection of the most beautiful photos and their editing is also a subject of artistic inspiration of Photographer. Unprocessed photos (RAW photos) are not available for purchase, as they are not considered a final product. Mulec Weddings undertakes that the number of photos will be in the range specified in the offer. The number of photos may vary depending on the complexity of the wedding, weather conditions and other conditions on the wedding day itself.
All image sizes are nominal. A Photographer will achieve a pleasing color balance, but cannot guarantee an exact color match due to irregular reflection caused by a combination of certain physical circumstances. Sometimes it is impossible to capture colors exactly as seen by the human eye.

Photoshop retouching (skin retouching, volumes and other changes) is never included in the selected package offer for any person in the images. If Clients want some photoshop retouching on the images, they should ask for a quote, which will depend on the number of images and changes the Clients wants to have.


- DELIVERY DEADLINES
The Client receives edited photos in digital form through a connection via e-mail. The Client will receive the photos within 60 working days after taking the photos and paying 100% of the agreed amount (both conditions must be fulfilled). With an additional payment, the Client can also decide to get the edited photos within 10 working days after taking photos and payment. In the event of unforeseen events (force majeure - death, death in the family, serious illness, quarantine order, pregnancy or pregnancy complications, etc.) or the postponement of weddings of other Clients and increased scope of work due to the adoption of measures to curb the spread of the coronavirus, Mulec Weddings reserves the right to a later delivery of photos and products as agreed.

The Client receives the first 5 photos of the wedding day no later than five days after the wedding.

The deadline for the delivery of photo books and other printed products depends on the date of the order, confirmation of the photo layout proposal and the estimated delivery time of the printing company. In the case of ordering exclusive photo books made by Mulec Weddings, the deadlines are 60 working days from the date of confirmation of the photo book proposal. For all photo books, a 100% payment in advance is required for the order to take place.

- RECEIVING AND ARCHIVING PHOTOS
After receiving the digital media physically or through an online service, the Client assumes all responsibility for archiving and protecting the photos. The Photographer is not obliged to archive the image files for more than 60 calendar days after receiving the delivery confirmation (the Photographer receives this notification as soon as the gallery is downloaded by the Client). The Photographer is not responsible for the lifetime of any digital media provided or for any future changes in digital technology or media readers that may result in the inability to read the digital media. Client is responsible for ensuring that digital files are copied and backed up to new media as necessary.


- COPYRIGHT
Copyright Designs and Patents Acts assign the copyright of the images to the Photographer. As so, all photographs taken by the photographers at the Event, in whatever form, are copyright protected. The Photographer will allow reproduction and publishing for personal use (e.g. wall hangings at home, Facebook, blogs), but any sale or publication for profit without Photographer's express written permission is a violation of copyright law. Photographer retain copyright in all images taken at the Event. This clause shall survive the Terms and Conditions that will be agreed.
In the case of publishing photos, the Client must state the author's name in the format "photo: Mulec Weddings". For commercial publication in the media, permission from the Photographer must be obtained prior to publication. Sending photos to other wedding service providers (makeup providers, florists, wedding planners, wedding blogs, etc.) is allowed with the appropriate indication "photo: Mulec Weddings". Sending photos to other photographers is prohibited.


- PROTECTION OF PERSONAL DATA
The Photographer undertakes to protect the personal data obtained in the process of booking the photography service in accordance with the Personal Data Protection Act (ZVOP-2) and the EU General Data Protection Regulation (GDPR). The Photographer will not use the Client's personal data for any other purpose than exclusively for quality execution of photography services, communication with the Client and forwarding of photos to the Client. Personal data is stored permanently. Without the explicit prior written consent of the Client, the Photographer will not forward personal data to third parties or use it for purposes other than those stated in this article. The data on the invoices is forwarded to the accounting service, which also operates in accordance with the Personal Data Protection Act (ZVOP-2) and the EU General Data Protection Regulation (GDPR).


- VALIDITY OF THE CONTRACT AND GENERAL TERMS AND CONDITIONS
The Terms and Conditions are published on the website www.mulec-weddings.com . By reserving a photography service at Mulec Weddings, the Client undertakes to have read the Terms and Conditions, is familiar with them, agrees with them and undertakes to respect them. Mulec Weddings reserves the right to change the Terms and Conditions at any time.


- ONLINE GALLERY
Online galleries last six months for portrait photo shoots and one year for weddings from the date of delivery. After this time, the Photographer is no longer obliged to keep online galeries.


Mulec Weddings and the Client resolve misunderstandings amicably. Under no circumstances may the Client publicly (via blogs, forums, social networks, etc.) insult, slander, perform or embarrass Mulec Weddings or the photographers personally. In the event of a misunderstanding, Mulec Weddings will take legal action. If the resolution of a possible dispute cannot be reached by agreement, or if there is insult or slander via the Internet and social networks, the Client and Mulec Weddings resolve the dispute through the competent court.
